Terms of Service

The short version. REM Nebula is a world-building game run by J A Reaver LLC. It's free to play; credits are optional and only pay for extra AI creations. Be at least 13, don't upload or create things you don't have the rights to or that hurt people, and remember this is an early test build. The full terms below are what count.

1. Who we are and what these terms cover

REM Nebula (the "Service") - the REM Nebula game for Windows, its online features (sign-in, AI creation, credits, publishing and playing shared worlds) and the website https://remnebula.com - is operated by J A Reaver LLC, a limited liability company organized in the State of Missouri, United States ("we", "us", "our"). You can reach us at support@remnebula.com.

By downloading, installing or using the Service you agree to these Terms of Service and to our Privacy Policy and Refund Policy. If you don't agree, don't use the Service.

2. Test builds

REM Nebula is in development and has not been officially released. Test builds are provided so people can try the game and tell us what they find. They may contain bugs, may change or lose features, and may stop working; worlds and other data from a test build may not carry over to later versions. Keep your own copies of anything important.

3. Who can use REM Nebula

You must be at least 13 years old to use the Service. If you're under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or legal guardian, and only a parent or guardian may buy credits or approve a purchase. Parents and guardians are responsible for purchases made by the minors they supervise.

4. Your account

Some features (AI creation, credits) need you to sign in with a Google account. You're responsible for what happens under your sign-in, and for keeping the device you play on secure. One person per account; don't share, sell or transfer accounts, and don't create extra accounts to get more free creations. We may suspend or close accounts that break these terms.

5. Your license to use REM Nebula

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use the REM Nebula software for your own non-commercial use, under these terms. REM Nebula, its software, logo and original content belong to us or our licensors. Parts of REM Nebula are made with open-source software and free-licensed assets, which remain under their own licenses (listed in the game's credits). You may not copy, sell, rent or redistribute the software, or reverse engineer, attack, overload or interfere with our servers, or use bots or automated tools against the Service.

6. What you create and share

You own what you make. Worlds, games, avatars and other content you create in REM Nebula ("Your Content") belong to you, along with any rights you already had in material you bring in.

When you publish or share Your Content in REM Nebula, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example, to make thumbnails or fit different screens) and distribute it within the Service and in promoting the Service, for as long as it stays published - so other players can find, play and remix it as the Service allows. You can unpublish your content at any time.

You're responsible for Your Content. Only upload or publish material you have the right to use. Don't create, upload or share anything that:

We check descriptions, uploads and shared worlds automatically, and we may refuse, hide or remove content - and suspend accounts - that break these rules. If you believe content in REM Nebula infringes your rights, email support@remnebula.com with the details and we'll review it promptly.

7. AI creation

REM Nebula can turn a description into a picture, and a picture (yours or one it made) into a 3D model, using third-party AI services. Please know that:

8. Free allowance and credits

Free allowance. Every signed-in player gets a number of free AI creations each day (currently 10 pictures and 2 3D models). Free creations are funded from a shared daily budget; when it runs out, free creation pauses until the next day (UTC). We may change the free allowance at any time.

Credits. Credits let you make AI creations beyond the free allowance. Currently a picture costs 1 credit and a 3D model costs 4 credits; the cost is shown in the game before you create. If a creation fails on our side, its credits are returned automatically.

Credits are a limited, prepaid license to use REM Nebula's AI creation features. Credits:

We may change how many credits a creation costs; we'll show the current cost in the game, and changes don't remove credits you already have. If we ever permanently close AI creation, we'll give at least 30 days' notice in the game and on this website, and refund the unused part of any credits bought in the 6 months before the notice. If we close your account because you broke these terms, unused credits are lost unless the law requires otherwise.

9. Payments

Credit purchases are processed by Paddle.com, our online reseller and Merchant of Record. Paddle handles payment, billing, sales tax/VAT, receipts and payment-related customer service, and Paddle's Buyer Terms apply to your purchase. Prices are shown in US dollars (Paddle may show your local currency) and taxes are added where they apply. Refunds are covered by our Refund Policy.

10. Other players' worlds

Shared worlds are made by other players, not by us. We don't check everything before it's published and aren't responsible for other players' content, but we act on reports. Please report anything that breaks these terms to support@remnebula.com.

11. Third-party services

The Service relies on other companies' services, including Google (sign-in), Paddle (payments), Cloudflare (hosting and storage) and AI model providers (AI creation). Their own terms may also apply to how you use them.

12. Ending things

You can stop using REM Nebula at any time and ask us to delete your account data (see the Privacy Policy). We may suspend or end your access if you break these terms, if required by law, or if we stop offering the Service. Sections 6 (license to published content, for as long as it remains published), 8 (credit rules), 13, 14 and 15 continue after your access ends.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR KEEP YOUR DATA. Some places don't allow these exclusions, so some may not apply to you.

14. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, J A Reaver LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR CREDITS IN THE 12 MONTHS BEFORE THE CLAIM AND US $50. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer under the law where you live.

15. Governing law

These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Missouri, and you and we consent to their jurisdiction - except that if you're a consumer living outside the United States, you also keep the protection of, and may bring claims in, the courts where you live. Before filing a claim, please email us so we can try to sort it out first.

16. Changes to these terms

We may update these terms as REM Nebula develops. If a change is significant, we'll tell you in the game or on this website before it takes effect. If you keep using the Service after a change takes effect, the new terms apply; if you don't agree, stop using the Service.
